Complaints about Licensed Immigration Advisers

Receiving a complaint from a client can be very confronting and stressful. How you handle a complaint can have significant implications on your reputation and that of your business.

Many Immigration Advisers are providing sound immigration advice, but it is also a fact of life that a significant number of complaints are made to the Immigration Advisers Authority (‘IAA’). These can lead to investigations and sanctions by the Immigration Advisers Complaints & Disciplinary Tribunal (‘Disciplinary Tribunal’).

How we can help immigration advisers

We are committed to providing you with clear, accurate advice as part of a professional, good value service.

We can help immigration advisers by:

  • providing preemptive complaint advice
  • putting forward all necessary and relevant evidence for consideration before the IAA
  • reviewing your policies and procedures to make sure they meet the requirements under the Licensed Immigration Advisers Code of Conduct
  • preparing the best possible written response when a complaint is made to the IAA
  • representing you before the Disciplinary Tribunal
  • giving advice on improvements to your policies or processes to avoid future complaints

We offer fixed-fee options for our legal service for complaints, so you know you’ve got all the support you need should you get into hot water. We would agree on the fee after we carry out an initial review of the complaint.

Assistance with complex visa applications and appeals

Our Immigration Team has extensive experience in all areas of immigration law. We can assist you with complex visa applications at any stage in the process as well as with Immigration and Protection Tribunal appeals.

Whether it is with a submission addressing relevant visa criteria or with a response to a Potentially Prejudicial Information letter. We have the expertise

We also have considerable experience in the preparation of appeals to the Immigration and Protection Tribunal.

Equally we can assist you where there is a potential or actual conflict of interest relating to your clients.

More than immigration law

As a full service law firm we have the resources to also offer any additional legal assistance you may require ancillary to your role as an immigration adviser.

In several decisions from the Immigration Advisers Complaints & Disciplinary Tribunal the adviser has been found to have breached the LIA’s Code of Conduct by getting too involved in issues of employment law without having the proper expertise. At Pitt & Moore we have particular expertise in employment law which you and your clients can benefit from.

We also offer advice in areas such as buying a home or business, Overseas Investment Office consents, establishing trusts, leasing, franchising, estate planning and many other areas relevant to new or prospective migrants.

We can also assist with claims before the Disputes Tribunal, the District Court and appeals to the High Court.
